Aneel, Anatel advance in improving pole sharing rules

Throughout this week, the technical areas of ANEEL and Anatel issued a proposal for a new regulation regarding the sharing of infrastructure between the electricity distribution and telecommunications sectors. The proposal aims primarily to modernize the rules to correct irregularities in the occupation of poles, resulting in greater safety for workers at distribution companies and telecommunications companies and for the entire population.

Created jointly by the Agencies, the proposal considers the contributions of agents in the electricity and telecommunications sectors, and other interested parties. Among the main innovations, we highlight the obligation to regularize the occupation of poles by telecommunications companies that are irregular, the creation of goals for society to monitor the evolution of regularization, rules to guarantee equal treatment of companies and the possibility of management of sharing through third parties.

Another important innovation is the establishment of a regulated price to be charged to pole occupants, promoting equal conditions and competitiveness in the telecommunications market. The methodology developed jointly by the two agencies to establish the price will be discussed with society in public consultation.

The definitive approval of the new rules and the opening of the second phase of Public Consultation 73/2021, which will specifically deal with the pricing methodology, should happen soon. The documents with the proposals are available in the Public Consultation space 73/2021.
