Brazil starts consultation for infrastructure bond regulations

Brazil’s transport ministry has kicked off a public consultation phase for the use of recently approved local bonds, known as infrastructure debentures. 

Approved in late 2023 by congress and signed off by President Luiz Inácio Lula da Silva earlier this year, different ministries will now create the regulatory frameworks for their respective areas.

The transport ministry is responsible for the areas of highways and railways.

There are two classes of debentures that carry tax breaks and are used for projects: infrastructure debentures, approved by congress last year; and incentivized debentures, which have been in existence since 2011. Incentivized debentures offer tax exemptions for investors who acquire them, while infrastructure debentures offer exemptions for the companies that issue these bonds.
