New Fortress takes Puerto Rico case to appeals court
New Fortress Energy (NFE) has filed a petition for review with the United States Court of Appeals for the District of Columbia Circuit related to the company’s LNG facility in Puerto Rico.
So reads a submission to the US Federal Energy Regulatory Commission (FERC) which in March determined that the facility is subject to the commission’s jurisdiction under the Natural Gas Act.
New York-based NFE subsequently requested a rehearing from FERC which issued a “notice of denial of rehearing by operation of law and providing for further consideration.”

Meanwhile, the island’s power utility PREPA (AEE in Spanish) has asked energy regulator NEPR to extend by 21 days to June 18 the deadline for the request for proposals for the first tranche of a total package to procure 3,750MW of renewable energy and 1,500MW of storage.
The request follows a petition from the Puerto Rico Solar Energy Industries Association – doing business as Solar and Energy Storage Association of Puerto Rico – for additional time to resolve issues with the RFP.
In its filing, PREPA said it “agrees that providing some amount of additional time for the completion of bid submissions is likely to generate greater bidder participation and better bid pricing.”
