Peru approves regulations for international land transport vehicles to use fuel with low sulfur content

Through the Official Gazette El Peruano, on October 8, 2023, Supreme Decree No. 018-2023-EM was published, which approves the Regulation of Law No. 31646 “Law that establishes that international land transport vehicles enter to the national territory, complying with Peruvian regulations regarding fuel quality.”

The regulations, endorsed by the head of the Ministry of Energy and Mines (MINEM), Oscar Vera Gargurevich, and his counterparts from the Ministry of Economy and Finance, Transport and Communications and the Presidency of the Council of Ministers, establishes that vehicles that cross the Peruvian borders, must enter the country using Diesel B5, Gasolines and Gasoholes with a sulfur content of no more than 50 ppm, in order to safeguard air quality.

This technical specification is given in accordance with what is stated in Supreme Decree No. 014-2021-EM, current Peruvian regulations on the quality of fuel use, which establishes measures to contribute to an improvement in the quality of liquid fuels, as well as as well as environmental quality levels.

According to the regulations, when the vehicle that does not comply with this technical specification, it may enter Peruvian territory with a certain amount of fuel for its journey to the nearest fuel public sale establishment (EVPC) within the country; depending on the entry border crossing where you are, in accordance with article 4 of the regulations.

On the other hand, the rule also states that the Osinergmin will approve the inspection and sanction procedure, as well as the classification of infractions and scale of fines and sanctions of the provisions contained in Law No. 31646 and its Regulations, within a period of 60 calendar days.

The MINEM highlights that this measure contributes to ordering the automotive fuel market and improving air quality, thus allowing the development of an energy sector with minimal environmental impact and low carbon emissions in a framework of sustainable development, in congruence with the Policy National Energy Agency of Peru 2010 – 2040.
